Macarthur Coal Limited - Panel Declines to Make Interim Order

The Panel has met to consider the application dated 7 April 2010 from Peabody Energy Corporation in relation to the affairs of Macarthur Coal Limited (see TP10/12). Peabody sought an interim order that Macarthur be required to postpone the shareholders' meeting scheduled for 12 April 2010 until the application is determined.

The Panel has declined to make the interim order sought.

The sitting Panel is Hamish Douglass (sitting President), Paula Dwyer and David Friedlander. The Panel has not yet made a decision whether to conduct proceedings.
