The Panel has made interim orders with respect to the review application (the Review Application) by CaptiveVision Capital Limited (CVC) concerning the off-market takeover bid (the Bid) by CVC for all the fully paid ordinary shares in Skywest Limited (Skywest).
The Review Application was the subject of Panel media release TP04/72, released on 4 August 2004.
The interim orders effectively maintain the status quo of the Bid during the review and restrict CVC and Skywest from initiating communications with Skywest shareholders regarding the Bid.
The interim orders remain in effect until the first to occur of:
- further order by the Panel;
- 1 September 2004; and
- the conclusion of the proceeding.
