The Panel has consented to the withdrawal of the application (the Application) from the Australian Securities and Investments Commission (ASIC) dated 9 July 2004 alleging unacceptable circumstances in relation to the affairs of The Gribbles Group Limited (Gribbles).
The Application related to the alleged failure by parties associated with EC Medical Investments NV (ECMI) to comply with the tracing and substantial holding provisions of the Corporations Act (2001) (Cth).
The Panel consented to the Application being withdrawn having regard to the disclosures made on behalf of Investec Trustees (Jersey) Limited, Jelsker Corporation NV, Palagiano Holding BV, Pianoro Holding BV, ECMI and Wallace Stuart Cameron on 16 July 2004 (as mentioned in the Panel’s media release TP04/60, released on 16 July 2004).
