The Takeovers Panel advises that it has, this evening, received an application from CEMEX Australia Pty Ltd (CEMEX) seeking review of the Panel's decision of 12 July 2007 to make a declaration of unacceptable circumstances and orders. The Panel's decision of 12 July 2007 (TP07/49) was in relation to an application received on Wednesday, 13 June 2007 from the Australian Securities and Investments Commission, in relation to an off-market takeover bid by CEMEX for Rinker Group Limited and the affairs of Rinker (TP07/38).
The Panel has not decided whether to conduct proceedings in relation to the review application and makes no comment on the merits of the application.
The President of the Panel has made an interim order staying the Panel's orders of 12 July 2007 while it considers the application for review.
The President of the Panel is currently appointing a Panel to consider the application.
