The review Panel has affirmed the decision of the initial Panel not to make a declaration of unacceptable circumstances in A S P Aluminium Holdings Pty Ltd (see TP23/21).
On 30 May 2023, the Panel received an application from Villefranche Investments Pty Limited as trustee of the Gates Family Trust seeking a review of the initial Panel’s decision in A S P Aluminium Holdings Pty Ltd (see TP23/22).
In light of all of the circumstances and evidence before it, the review Panel decided to affirm the decision of the initial Panel and declined to make a declaration of unacceptable circumstances.
As a result of the review Panel’s decision, the Acting President’s interim orders (see TP23/22) cease to have effect.
The sitting Panel was Robin Bishop, Bruce Cowley and Diana Nicholson (sitting President).
The Panel will publish its reasons for the decision in due course on its website.
