The Takeovers Panel (Panel) advises that it has decided to commence proceedings in relation to an application dated 14 January 2005 it received from WMC Resources Ltd (WMC) in relation to the takeover offer by Xstrata Capital Holdings Pty Ltd (Xstrata Capital) for all the shares in WMC.
The Panel announced on 13 January 2005 in TP05/07 that it had commenced proceedings in relation to an application made by Xstrata Capital in relation to WMC's target statement.
The Panel has decided to combine the proceedings for the two applications. It considers this is feasible without affecting the time frame for determining either proceedings.
The President of the Panel has appointed Nerolie Withnall (sitting President), David Gonski and Simon Withers as the sitting Panel in both proceedings.
