The Panel has posted a draft set of revised rules on its website for public consultation.
In paragraph 22 of the consultation paper, the Panel asks whether Daniels Corporation International Pty Ltd v ACCC has changed the law as stated in Corporations and Securities Panel v Bristile Investments Pty Limited regarding Panel proceedings.
An error was made in respect of the note on Daniels, which should read (in mark up):
"In Daniels Corporation International Pty Ltd v ACCC (2002) 213 CLR 543 the High Court did not allow a claim of legal professional privilege in respect of s155 of the Trade Practices Act 1974 (Cth)."
The Consultation Paper has been amended and is available on the Panel's website on the consultation page.
