The Takeovers Panel (the Panel) has today published the reasons for its decision in relation to an application for review of the Panel's decision in the APT01 proceedings (TP06/82) dated 3 September. The application for review was from Alinta Limited and was dated 5 September 2006 (TP06/83) in relation to the affairs of Australian Pipeline Trust.
Details of the APT01R Panel's decision in the review proceedings were announced on 20 September 2006 (TP06/90) and 23 September (TP06/92). These releases are available on the Panel's website at www.takeovers.gov.au.
The Panel also advises that Alinta has commenced proceedings in the Federal Court of Australia seeking judicial review of the Panel’s decision in the APT01R proceedings. The Court has ordered a stay of the Panel’s orders until such time as the judicial review proceedings are determined. The court has set an initial date for hearing the application for judicial review of 9 October 2006.
