The Panel announced today that it has published a revised version of its Guidance Note 04, "Remedies and Enforcement".
The reissue follows an amendment to paragraph 4.6, which deals with Panel orders and compliance with the statutory provisions. In the revised version the Panel states that it considers that its power to make orders under section 657D includes a power to make an order that a person do something contrary to a relevant provision in the Act, but not a power to make an order that a person do something contrary to another law.
The Panel also took the opportunity to update the guidance note to reflect the recent amendments in the Corporations Amendments (Takeovers) Act 2007.
