The Takeovers Panel advises that it has consented to Primary Healthcare Limited's (Primary) request to withdraw an application to the Panel dated 17 January 2008 in relation to the affairs of Symbion Health Limited (Symbion).
The application related to the provision of information under section 641 of the Corporations Act by Symbion to Primary. Primary informed the President that it has made the request to withdraw its application following a resolution of the matters the subject of the application.
The President is satisfied that it is not against the public interest to consent to Primary withdrawing its application.
The President had not appointed a sitting Panel at the time of Primary's request to withdraw its application.
