The Panel received an application dated 9 April 2010 from New Hope Corporation Limited in relation to the affairs of Macarthur Coal Limited.
New Hope sought (among other things) an interim order requiring Macarthur to postpone the shareholders' meeting scheduled for 12 April 2010 until its application was determined. Shortly after lodgement of the application, Macarthur announced that it had deferred the shareholders' meeting until 19 April 2010. Following this announcement, New Hope asked to withdraw its application.
The Acting President is satisfied that it is not against the public interest to consent to New Hope withdrawing its application.
A sitting Panel was not appointed at the time of New Hope's request to withdraw its application.
