The Takeovers Panel advises that it has consented to Skala Holdings Pty Ltd's request to withdraw an application to the Panel dated 5 February 2010 in relation to the affairs of Midwinter Resources NL.
The application related to the provision of information under section 641 of the Corporations Act by Midwinter to Skala. It was submitted that Midwinter had not provided the register of its members in the form requested. Shortly after lodgement of the application, Skala asked to withdraw its application following a resolution of the matters the subject of the application.
The President is satisfied that it is not against the public interest to consent to Skala withdrawing its application.
The President had not appointed a sitting Panel at the time of Skala's request to withdraw its application.
